3.1 Safety acknowledgement
You acknowledge that the Service provides instructional content concerning machine tools and manufacturing equipment that can cause serious injury or death if applied improperly.
You agree that you will not apply any program, setup, blueprint or procedure from the Service to physical equipment except under the direct supervision of a qualified instructor or subject matter expert, and only after the program or setup has been independently verified on that equipment by qualified personnel.
Parameters shown in the curriculum are illustrative and specific to the example equipment and setup shown, and may be unsafe on other equipment. The Service is not a substitute for hands-on training, supervision, or the operating and safety documentation supplied with your equipment.
4. Intellectual property
The Service, all courses, content and downloadable resources — including software, 3D models, simulations, drawings, images, video, questions and answer keys — are owned exclusively by us and protected by copyright, trade secret and other laws. All rights not expressly granted in this agreement are reserved.
4.1 Content protection
The Service uses technical protection measures to protect its content. These may include encryption, watermarks that identify the organization or account to which content was delivered, and access logging, as described in our Privacy Policy. Circumventing these measures is prohibited by this agreement and may also violate law, including 17 U.S.C. § 1201.
4.2 Third-party content
Some 3D models and media in the Service are used under their own licences, such as Creative Commons licences, and are credited on our Acknowledgements page. Those licences apply to those items.
5. Data ownership and privacy
Reports, certificates and progress records belong to your institution. Consistent with our Privacy Policy:
What we collect — only the minimal student data needed to run the Service:
- First and last name, or an identifier chosen by the instructor or school
- Email address, used only for password recovery
- Password
What we do not collect — sensitive information such as birth dates, Social Security numbers, school-issued student IDs, grades, transcripts, addresses or phone numbers. The Service contains no posting or electronic communication features.
Who controls the data — as between the parties, the educational institution or organization is the data controller of education records and student data under FERPA. The Company acts solely as a data processor, and processes such data only as necessary to deliver the Service and in accordance with the institution’s instructions.
6. Term and termination
This agreement remains in effect while you have access. We may suspend or terminate access for violation of this agreement or the Customer Agreement. A breach of section 3 or section 4 may result in immediate termination without notice, and we may seek any remedy available at law or in equity, including injunctive relief. Upon termination, stop using the Service and delete any downloaded resources, except those retained for legitimate educational records.
7. Warranties and disclaimers
The Service is provided “as is”. We disclaim all warranties, express or implied, to the maximum extent permitted by law. Subject to section 10 below.
8. Limitation of liability
Our total liability shall not exceed the amount paid for the renewal. We are not liable for indirect, consequential or incidental damages. Subject to section 10 below.
9. Governing law
This agreement is governed by the laws of the State of Michigan. Venue is in the courts of Oakland County, Michigan. Subject to section 10 below.
10. Public educational institutions and government entities
This agreement is intended to comply with all applicable federal, state and local laws governing public educational institutions and government entities. In the event of any conflict between this agreement and any mandatory law, regulation or required governmental addendum, the applicable law, regulation or addendum shall control solely for that customer.
Any provision in this agreement that is prohibited or unenforceable for a public educational institution shall be automatically deemed modified or deleted to the minimum extent necessary to comply, while preserving the intent of the parties to the greatest extent possible. The Company will work in good faith with the Customer to accommodate any lawful requirements.
